The fine print
Terms of Service
These are the terms of the deal between you and The Fundraising Co. LLC, the company behind The Fundraising Co. We have kept them in plain language on purpose. If anything here is unclear, write to Patrick@thefundraisingco.com and a person will answer.
Agreement to these terms
You accept these terms when you check the box to agree at sign-up or checkout, and by using the paid service. We record that acceptance and the version you agreed to. If you do not agree, do not use the paid service. The free resources are open either way.
The service
The Fundraising Co. is a membership site for nonprofit fundraisers: training organized into eight sector tracks and four career stages, a library of templates and working documents, and, once it opens, a member community. We add and revise material continually, so the exact contents shift over time. The shape of the offer, and its price, are published on the pricing page.
Your account
Sign-in works by magic link: we email you a link, you click it, you are in. There is no password to remember, which also means your email inbox is the key to your account, so keep it secure. You are responsible for activity that happens under your account, and one account belongs to one person.
Membership and billing
- Membership comes in the tiers published on the pricing page (currently Member, Studio, and Team), billed annually or month-to-month depending on the plan you choose.
- These are automatically renewing subscriptions. Annual plans renew once a year and monthly plans renew once a month, at the then-current price for your plan, and continue until you cancel. The renewal frequency and amount are shown at checkout before you pay.
- You can cancel any time, in a few clicks, from the billing portal in your account. Cancelling stops all future charges; access runs through the end of the period you have paid for.
- After you subscribe, we email you a confirmation you can keep: the plan, the renewal date and amount, how to cancel, and the refund policy. For annual and Team plans we also send a reminder before each renewal.
- Studio review credits. A credit covers one document (an appeal, case statement, plan, or similar working document up to 10 pages) with written feedback returned within five business days of submission. Annual Studio includes four credits per membership year; on monthly Studio, one credit becomes available for each three months of continuous membership. Credits do not roll over, and unused credits carry no cash value.
- The founding rate is capped. The $290/yr founding rate is limited to the first 250 founding members and stays locked for as long as the membership remains continuously active. If it lapses, the then-current price applies on rejoining.
- Payments are processed by Stripe. Your card details go directly to Stripe; we do not see or store your full card number.
- If we change a price, we will email you at least 30 days before it applies to your renewal so you can cancel before the new price takes effect. We do not raise your renewal price without notice.
- Refunds are covered by our refund policy, including the 30-day money-back guarantee on annual and Team plans.
Taxes
Prices are exclusive of sales tax, VAT, and similar taxes. Where we are required to collect them based on where you are, they are added at checkout and shown before you pay.
Acceptable use
A membership is a personal seat. Do not share your login, scrape or repost lessons, or resell access. A Team plan covers up to five named seats within one organization.
The templates deserve a clear distinction, because it matters. Every template, script, and worksheet in the Materials Library is meant to be used: adapt it, put your organization's name on it, send the appeal, run the campaign. You may use the materials in your shop's real work freely, without limit and without credit. What you may not do is redistribute the templates themselves outside your organization: repackaging them, posting them publicly, or passing copies along to other shops. Use the work; do not hand out the toolbox. Point colleagues at other organizations to the site instead.
Intellectual property
The lessons, templates, curriculum structure, wording, and wordmark belong to The Fundraising Co. LLC. Your membership is a license to use them under these terms, not ownership of them. The documents you produce with the templates (your appeal letters, your case for support, your stewardship plan) are yours entirely.
Disclaimers
This is education, not professional advice. Fundraising touches law, tax, and finance, and the rules vary by state and country. When a decision has legal or financial consequences, such as charitable registration, gift acceptance, or tax receipts, check with a qualified professional who knows your situation.
THE SERVICE AND ALL MATERIALS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We work hard to keep the service accurate and available but do not warrant that it will always be either.
Limitation of liability
In plain terms: to the fullest extent the law allows, our total liability to you is capped at the amount you paid us in the twelve months before the claim.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST DONATIONS, LOST REVENUE, OR THE OUTCOME OF A CAMPAIGN.
Nothing here limits liability that cannot be limited by law, such as for fraud or personal injury. Some jurisdictions do not allow parts of this limitation, in which case it applies only as far as the law permits.
Termination
You can cancel any time; your access runs through the end of the period you have paid for. We can suspend or close accounts that violate these terms (seat sharing and redistributing materials matter most), and we will normally warn you first unless the violation is serious. If we ever close your account without cause, we will refund the unused portion of your membership.
General terms
These terms, together with the privacy and refund policies, are the entire agreement between us and replace any earlier understanding on the same subject. If any part is found unenforceable, the rest stays in effect. Our not enforcing a term once does not waive it. You may not assign your membership; we may assign these terms to a successor if the business is sold or reorganized. Neither of us is responsible for delays or failures caused by events beyond reasonable control. The sections on intellectual property, disclaimers, and limitation of liability survive after your membership ends.
Before paid checkout opens
The final checkout agreement will identify the governing law and venue before anyone purchases a membership. We would much rather sort out a problem directly first; most things resolve faster that way.
Changes to these terms
We may update these terms as the service grows. If a change is significant, members get email notice at least 30 days before it takes effect; continuing to use the service after that date means you accept the change. The current version always lives at this page.
